| Abstract: | V diplomové práci se zabývám znalectvím, postavením znalce v trestním řízení a znaleckým posudkem jako důkazním prostředkem. Po historickém exkurzu ve znalectví v diplomové práci hodnotím předchozí a současnou právní úpravu znalecké činnosti. Poté již vycházím pouze z platné právní úpravy znalectví a rozebírám osobu znalce a její postavení v rámci trestního řízení. V další části se věnuji znaleckému posudku jako důkaznímu prostředku. |
| Abstract in different language: | In my diploma thesis I deal with expert witnesses, the position of the expert in criminal proceedings and the expert opinion as a means of evidence. After a historical excursion in the field of expertise, I evaluate the previous and current legal regulation of expert activities. After that, I base only on the current legal regulation of expertise and discuss the person of the expert and his/her position in criminal proceedings. In the next part I discuss the expert opinion as a means of evidence. |
