| Abstract: | Tato diplomová práce podrobně rozebírá smrt jako objektivní právní skutečnost z pohledu českého soukromého práva. Jejím hlavním cílem je představit právní úpravu smrti, vymezit její pozici v českém právním řádu a poukázat na skutečnost, jak se vzájemně ovlivňují ony dva obory, kterými je právo a medicína. K dosažení výše uvedeného cíle tato diplomová práce pojednává o problematice vymezení pojmu smrti a stanovení okamžiku smrti, což rovněž zahrnuje otázky týkající se zániku právní osobnosti člověka. V návaznosti na to jsou rozebrány postupy, kterými je smrt zjišťována. Nedílnou součást této diplomové práce tvoří procesní úprava prohlášení člověka za mrtvého a určení data smrti. Velice zajímavou problematiku obsahuje rovněž část, kde je rozebrána postmortální ochrana, ale i samotné pohřbívání a nakládání s lidskými pozůstatky a ostatky. |
| Abstract in different language: | This diploma thesis discusses death in detail as an objective legal fact from the perspective of Czech private law. Its main goal is to introduce the legal regulation of death, to define its position in the Czech legal order and to point out how the two fields, which are law and medicine, interact. To achieve the above-mentioned goal, this diploma thesis deals with the issue of defining the concept of death and determining the moment of death, which also includes issues related to the demise of a person's legal personality. Following this, the procedures by which death is detected are analyzed.An integral part of this diploma thesis is also the procedural adjustment of the declaration of a person as dead and the determination of the date of death. A very interesting issue is also included in the part where post-mortem protection is discussed, but also the burial itself and the handling of human remains. |
