| Abstract: | Maďarsko a Polská republika se potýkají s krizí právního státu v důsledku vládních kroků, které vedly k ohrožení nezávislosti justice, svobody slova či systému dělby moci. Bakalářská práce se zabývá vybranými mechanismy na ochranu zásad právního státu, kterými EU disponuje, čímž může státy sankcionovat. Jedním z nich je postup podle článku 7 SEU, který může vést až k pozastavení hlasovacích práv v Radě EU. Zároveň je představen pojem právní stát. Další část práce se věnuje rozboru probíhajícím reformám ze strany polské a maďarské vlády, kdy řada z nich vedla až k uplatnění nástrojů k prosazování zásad právního státu, přičemž v práci je kladen důraz na jejich průběh a výsledky aplikace, v neposlední řadě se zaměřuje na nedostatky a limity těchto nástrojů. |
| Abstract in different language: | Hungary and the Republic of Poland are facing a crisis of the rule of law as a result of government actions that have led to perils to the independence of the judiciary, freedom of speech and the system of separation of powers. The bachelor thesis examines selected rule of law protection mechanisms at the EU's disposal, which can sanction states. One of them is the procedure under Article 7 TEU, which can lead to the suspension of voting rights in the EU Council. At the same time, the concept of the rule of law is introduced. The next part of the thesis is devoted to the analysis of the ongoing reforms by the Polish and Hungarian governments, many of which have led to the application of instruments to enforce the rule of law; the thesis focuses on their progress and the results of their application, last but not least, it focuses on the shortcomings and limits of these instruments. |
