| Abstract: | Tato diplomová práce zkoumá různorodé aspekty Úmluvy Rady Evropy o prevenci a potírání násilí vůči ženám a domácího násilí neboli Istanbulské úmluvy. První kapitola je zaměřena na komparaci Istanbulské úmluvy s jinými mezinárodními smlouvami zabývajícími se ženskými právy. Druhá kapitola zkoumá okolnosti přijetí textu Istanbulské úmluvy, a to včetně specifik, v jejichž důsledku mohlo dojít k nestandardnímu schválení tohoto textu Radou Evropy. Důležitou částí této diplomové práce je kapitola zabývající se Istanbulskou úmluvou v kontextu Evropské unie a také ratifikačním procesem, který Istanbulská úmluva v rámci Evropské unie absolvovala. Čtvrtá kapitola rozebírá ideová východiska Istanbulské úmluvy, pátá kapitola pak vybrané instituty a závazky v kontextu dopadů tohoto mezinárodně právního dokumentu. Šestá kapitola analyzuje monitorovací orgán GREVIO a některé problematické aspekty, které z jeho výstupů vyplývají. V závěru tato práce představuje český kontext ratifikačního procesu Istanbulské úmluvy, který v lednu 2024 prozatím skončil odmítnutím Istanbulské úmluvy ze strany Senátu. |
| Abstract in different language: | This thesis examines various aspects of the Council of Europe Convention on Preventing and Combating Violence against Women and Domestic Violence, or the Istanbul Convention. The first chapter focuses on comparing the Istanbul Convention with other international treaties dealing with women's rights. The second chapter examines the circumstances surrounding the adoption of the text of the Istanbul Convention, including the specifics that may have led to the non-standard approval of the text by the Council of Europe. An important part of this thesis is the chapter dealing with the Istanbul Convention in the context of European Union law, as well as the ratification process that the Istanbul Convention underwent within the European Union. The fourth chapter discusses the ideological background of the Istanbul Convention, while the fifth chapter discusses selected institutions and obligations in the context of the impact of this international legal document. The sixth chapter analyses the monitoring body GREVIO and some of the problematic aspects arising from its outputs. Finally, this thesis presents the Czech context of the ratification process of the Istanbul Convention, which has so far ended with the rejection of the Istanbul Convention by the Senate in January 2024. |
