| Abstract: | Diplomová práce se věnuje tématu Rozvod manželství s mezinárodním prvkem. Cílem diplomové práce je podat ucelený přehled problematiky rozvodu manželství s mezinárodním prvkem, zejména v teoretické rovině. Diplomová práce sestává celkem z pěti kapitol. První kapitola se věnuje historickému vývoji zániku manželství na území dnešní ČR. Druhá kapitola se věnuje současné právní úpravě rozvodu manželství dle zákona č. 89/2012 Sb., občanský zákoník. Třetí kapitola je stěžejní kapitolou této diplomové práce, jelikož pojednává o rozvodu manželství s mezinárodním prvkem, a to jak na národní, evropské i mezinárodní úrovni. Čtvrtá a pátá kapitola se věnují komparaci právních úprav rozvodu manželství s mezinárodním prvkem, nejprve jsou porovnávány relevantní právní předpisy ČR a Slovenska a posléze ČR a Mongolska. |
| Abstract in different language: | The diploma thesis deals with the topic Divorce of a marriage with an international element. The aim of the diploma thesis is to provide a comprehensive overview of the issue of divorce with an international element, especially on a theoretical level. The diploma thesis consists of a total of five chapters. The first chapter is devoted to the historical development of the dissolution of marriage in the territory of today's Czech Republic. The second chapter deals with the current legal regulation of divorce according to Act No. 89/2012 Coll., Civil Code. The third chapter is the pivotal chapter of this diploma thesis, as it deals with divorce with an international element, at national, European and international level. The fourth and fifth chapters are devoted to the comparison of the legal regulations of divorce with an international element, first the legal regulations of Czech Republic and Slovakia are compared, and then legal regulations of Czech Republic and Mongolia. |
