| Abstract: | Práce se zaměřuje na popsání jednotlivých dědických titulů, tedy dědické smlouvy, závěti a intestátní dědické posloupnosti, a to zejména se zaměřením na dědickou smlouvu. Cílem bylo též popsat vybrané problematické aspekty dědické smlouvy, jelikož v právní úpravě tohoto institutu existují sporná místa, kde se nabízí vícero výkladů a ani odborníci se ne vždy na výkladu některých ustanovení shodují a zároveň bylo cílem nabídnout možné řešení těchto problémů, přičemž autorka vychází z názorů odborníků, kteří se dané problematice věnovali. První kapitola je věnována historickému kontextu. Druhá kapitola se zaměřuje na dědickou smlouvu a další dědické tituly, tedy závěť a intestátní dědickou posloupnost. Poslední kapitola je věnována náležitostem dědické smlouvy, kde je rozebírána zejména problematika volné čtvrtiny a vztah volné čtvrtiny a povinného dílu. |
| Abstract in different language: | This thesis focuses on describing the individual hereditary titles, i.e. inheritance contract, testament and intestate succession, with a particular focus on the inheritance contract, since there are disputed points in the legal regulation of this institute, where several interpretations are offered and even experts do not always agree on the interpretation of certain provisions. The aim is therefore to describe selected problematic aspects of inheritance contract and to offer possible solutions to those.This thesis is divided into three parts, the first of which is devoted to the historical context. The second part of the thesis is focused on inheritance contract and other hereditary titles, which are testament and intestate succession. The last part is devoted to the formalities of the inheritance contract, in particular the Falcidian Quartet. |
