| Abstract: | Tato diplomová práce se člení na úvod, 5 kapitol a závěr. Zaměřuje se na různé aspekty důkazního břemena v civilním řízení, včetně jeho definice, rozdělení na subjektivní a objektivní, a souvislosti s procesem dokazování. Kapitoly se také věnují souvisejícím pojmům, pravidlům dělení důkazního břemena mezi stranami sporu a praktickým aspektům judikatury. Autorka rovněž zkoumá problematiku informačního deficitu a jeho dopady na spravedlivý průběh civilního řízení. |
| Abstract in different language: | This thesis is divided into an introduction, 5 chapters and a conclusion. It focuses on various aspects of the burden of proof in civil proceedings, including its definition, the division into subjective and objective, and the connection with the process of proof. The chapters also deal with related concepts, rules for dividing the burden of proof between the parties to the dispute and practical aspects of jurisprudence. The author also examines the issue of information deficit and its effects on the fair course of civil proceedings. |
