| Abstract: | Tato diplomová práce se věnuje otázkám správy majetku v trestním řízení a poskytuje náhled do této problematiky. Nejde však o vyčerpávající analýzu problému. V teoretické rovině, pro zasazení správy majetku do kontextu výkonu státní moci, stručně popisuje státní moc a její jednotlivé pilíře. Seznamuje s veřejnou správou a jejím členěním. Popisuje relace veřejné správy k moci soudní a zákonodárné a přibližuje vykonavatele státní správy a jejich úkoly, které plní v přímé souvislosti se zajištěným a spravovaným majetkem. V další části má ambici přiblížit a definovat činnost pověřeného správce majetku v trestním řízení jako činnost aktivní, prováděnou vykonavateli státní správy nebo soukromými subjekty, pro orgány činné v trestním řízení, podle jejich pokynů, bez úplatně nebo za úplatu, za použití vlastních metod a postupů a na vlastní nebezpečí. Obsahuje popis některých postupů a seznamuje s institucemi, které jsou oprávněny tuto činnost vykonávat. Zvláštní akcent je věnován činnosti MV ČR - Centra zajištěných aktiv (MV-CENZA). Přitom seznamuje a dává do kontextu současnou právní úpravu s připravovanou novelu zák. č. 279/2003 Sb., o výkonu zajištění majetku a věcí v trestním řízení, jejíž účinnost se očekává od 1.7.2024. |
| Abstract in different language: | This diploma thesis deals with the issues of property management in criminal proceedings and provides an insight into this matter. This is although not an exhaustive analysis of the problem. On a theoretical level, to place property management into the context of the exercise of state power, it briefly describes state power and its individual pillars. It introduces public administration and its structure. It describes the relations between the public administration and the judicial and legislative powers, and provides an overview of the executors of the state administration and their tasks, which they perform in direct connection with secured and managed property. In the next part, the ambition is to approach and define the activity of the authorized administrator of assets in criminal proceedings as an active action carried out by executors of the state administration or private entities, for law enforcement authorities, according to their instructions, free of charge or for a fee, using their own methods and procedures and at their own risk. It contains a description of some procedures and introduces the institutions that are authorized to perform this activity. A special accent is devoted to the activities of the Ministry of the Interior of the Czech Republic - Center for Secured Assets (MV-CENZA). At the same time, it introduces and puts into context the current legislation with the upcoming amendment to Act. No. 279/2003 Coll., on the execution of the property and objects seizure in criminal proceedings, the effectiveness of which is expected from 1 July 2024. |
