| Abstract: | Diplomová práce se zabývá přístupem českých soudů k poučovací povinnosti podle § 118a odst. 1-3 o. s. ř. V předkládané práci je uveden historický vývoj poučovací povinnosti a následně je charakterizována poučovací povinnost dle § 118a odst. 1-3 o. s. ř. podle dnešní právní úpravy. Zároveň se práce zaměřuje na vztah poučovací povinnosti dle § 118a odst. 1-3 o. s. ř. s koncentrací řízení. |
| Abstract in different language: | Information duty of the court constitutes a necessary part of the present civil justice. On the basis of the information duty of the court according to the section 118a, paragraph 1 to 3 of Act No. 99/1963 Coll., Civil Procedure Code, the court directs parties to possibility of gaining success in the negotiated dispute. |
