| Abstract: | Diplomová práce je systematicky rozdělena na dvě velké části, kdy v prvé autor pojednává o době císaře Justiniána a jeho kodifikaci Diegesta seu Pandectae, obecně vymezuje a charakterizuje nabývací způsoby vlastnictví, kdy ve zkratce shrnuje derivativní způsoby nabývání vlastnictví a zbytek části, která je nejrozsáhlejší, je věnován originárním nabývacím způsobům vlastnictví, mezi které je pro účely této práce řazena okupace, nález pokladu, specifikace, smísení a slití, přírůstek, zpracování a nabytí plodů. Výše uvedené instituty jsou v této části vykládány tak, jak je nechal Justinián sepsat v Digestech ve fragmentu 41.1., který byl autorem přeložen a je součástí této práce. V části druhé se autor zaměřil na srovnání římskoprávní úpravy s česko-právním uspořádáním nabývacích způsobů a to s obecným zákoníkem občanský, tzv. středním zákoníkem občanským, současnou právní úpravou a s novým občanským zákoníkem, která byla z důvodu aktuálnosti rozebrána větší měrou. |
| Abstract in different language: | This Master Degree Thesis is systematically divided into two major parts, where the one deals with the time of Justinian the Emperor and his codification of Diegesta seu Pandectae, it delimits and characterizes title ownership ways in general, where there are to be summed up derivative ways of ownership acquiring briefly and the rest of this part, which is the largest one, is dedicated to originary ownership acquiring ways, where for the purpose of this work, there are to be mentioned occupation, treasure discovery, specification, blending and alloying, growth, fruit processing and gaining. The above mentioned institutes are in this part interpreted in the way, as Justinian had them written down in Digesta in fragment 41.1 and which were translated by the author and which are parts of this work. The other part of this Thesis is to be oriented on comparison of Roman law legislation with Czech law legislation of ownership acquiring way with general Civil Code , that means with middle Civil Code, current legislation and the new Civil Code, which this part focuses on, on the account of its up-to-dateness. |
