| Abstract: | Moje diplomová práce se zabývá problematikou vazby a možnostmi jejího nahrazení, které nabízí současný trestní řád. Práce je rozdělena do pěti kapitol. V první kapitole pojednávám všeobecně o institutu vazby. Druhá kapitola obsahuje historický vývoj jednotlivých substitutů vazby. Stěžejním bodem mé práce je kapitola třetí s názvem "právní úprava nahrazení vazby de lege ferenda". Čtvrtá kapitola obsahuje srovnání s právní úpravou vazby a substituty jejího nahrazení na Slovensku. V poslední kapitole se zabývám úvahami de lege ferenda se zaměřením na využití elektronického monitoringu při nahrazení vazby. |
| Abstract in different language: | My thesis deals with the custody and possibilities of its replacement, provided by the current Penal Code. The work is divided into five chapters. In the first chapter I discuss generally about the institute of custody. The second chapter contains the historical development of substitutes custody. The main point of my work is the third chapter, titled "legislation replacing substitutes of custody de lege ferenda". The fourth chapter provides a comparison with the legislation replacing of custody and substitutes of custody in the Slovak Republic. The last chapter deals with the de lege ferenda aimed at the use of electronic monitoring in replacing custody. |
