| Abstract: | Diplomová práce "Poučovací povinnost soudu v civilním řízení" je zaměřena na význam, rozsáhlost a důležitost poučovací povinnosti soudu v průběhu civilního procesu, jehož základním pramenem je zákon č. 99/1963 Sb., občanský soudní řád. S využitím právní teorie jsou vymezeny a charakterizovány pojmy poučovací povinnost a civilní řízení, na které navazuje popis forem poučení a rozbor obsahu poučovací povinnosti. Dále je provedena analýza současné právní úpravy poučovací povinnosti v civilním řízení a snaha o zhodnocení vlivu poučovací povinnosti na průběh a na výsledek řízení, se zaměřením na popis jednotlivých druhů poučovací povinnosti upravených v občanském soudním řádu, na jejich současnou právní úpravu, jejich specifické rysy a na jejich vzájemný vztah. |
| Abstract in different language: | The Master's thesis "Duty of the court to instruct in civil procedure" deals with the significance, comprehensiveness and importance of the duty of the court to instruct in the course of civil procedure on the grounds of Act No. 99/1963 Coll., Civil Procedure Act, as its main siurce. By using juristic theory, the therms duty to instruct and civil procedure are defined and characterized, followed by a description of the forms of instructing and analysis of the conten of the duty to insruct. In addation, an analysis is made of the existing legal regulation of the duty to instruct in civil procedure and an effort is made to evaluate the impact of the duty to instruct on the course and a result of the proceedings, dealing mainly with the description of individual kinds of the duty to insteuct regulated by Civil Procedure Act, their current regulation, their specific elements, and their mutual relationship. |
