| Abstract: | Práce se zabývá institutem manželství, primárně pak problematikou jeho vzniku a zániku, za aplikace současné právní úpravy, místy s komparací s právní úpravou předchozí. V úvodní části autorka přibližuje pojem a podstatu manželství. Pozornost je dále věnována fázi vzniku manželství, zejména osobním předpokladům, formám sňatku, sňatečnému procesu, obřadu a okamžiku uzavření manželství a jeho právním následkům. Následně autorka rozebírá fázi zániku manželství, jednotlivé způsoby zániku a jeho právní následky. V závěrečné části práce je krátce přiblížena autorčina úvaha nad budoucí právní úpravou. |
| Abstract in different language: | The work deals with the institution of marriage, primarily the issue of creation and destruction from the point of view of current legislation including a comparison with the previous legislation. In the first part the author brings the concept and essence of marriage. Attention is also paid to the stage after the marriage, especially personal assumptions, forms of marriage , proceedings before wedding, elements of the wedding ceremony and its legal consequences. Subsequently, the author analyzes the stage of dissolution of marriage, different methods of extinction and its legal consequences. In the final part there is briefly approached the author´s reflection on the future legislation. |
