| Abstract: | Diplomová práce je zaměřena problematiku přechodu pozůstalosti na dědice. Práce se nejprve orientuje na popis a analýzu právních důvodů dědění, neboť jsou základním předpokladnem k tomu , aby na dědice vůbec mohla přejit pozůstalost, ale jsou to rovněž předpoklady pro přechod dluhů na dědice. Dále je práce zaměřena na vymezení pojmů (tzn. pozůstalost a dědictví) . V práci jsou také zaznamenány změny právní úpravy týkající se přechodu pozůstalosti. Cílem diplomové práce je seznámení se z novými instituty dědického práva, jejich z hodnocení a problematikou přechodu pozůstalosti na dědice, podle současné právní úpravy, s účinností k 1.1.214. |
| Abstract in different language: | The thesis is focused on the issue of transition estate heir. Firstly, the work focuses on the description and analysis of the legal grounds of succession, since they are essential prerequisite to the heirs of the estate could even move on, but they are also prerequisites for the transition debts to heirs. Further work is focused on defining terms (ie. The estate and inheritance). The paper also reported changes in legislation relating to the transition of the estate. The aim of this thesis is the introduction of new institutions of inheritance law, their assessment of the issue and transfer of the estate to the heirs, under current legislation, with effect 1.1.2014. |
