| Abstract: | Diplomová práce je zaměřena na problematiku právní úpravy institutu místního a krajského referenda na území České republiky. Práce se věnuje postupu při organizování referenda na místní i regionální úrovni, soudní ochraně v otázkách referenda a dalším související otázkám. Platná právní úprava místního referenda je následně komparována s právní úpravou ve zvolených zahraničních právních řádech. V práci se rovněž pozastavím u statistiky místních referend, kde budou zkoumány počty uskutečněných referend od roku 2014 do současnosti, jejich úspěšnost a případné problematické aspekty. Cílem práce je tedy zhodnocení současné platné právní úpravy tohoto významného prvku přímé demokracie, ke kterému však není v naší zemi zcela správným a odpovídajícím způsobem přistupováno. |
| Abstract in different language: | The thesis is focused on the issue of legal regulation of the institute of local and regional referendum in the territory of the Czech Republic. The paper deals with the organization of the referendum at local and regional level, judicial protection on referendum issues and other related issues. The current legal regulation of the local referendum is then compared with the legislation in the selected foreign jurisdictions. In my work, I will also suspend some statistics of local referenda, where the numbers of referendums will be examined from 2014 to date, their success and possible problematic aspects. The aim of the thesis is to evaluate the current legal regulation of this important element of direct democracy,but which is not entirely correct and adequately addressed in our country. |
