Abstract: | Diplomová práce komplexně, nikoliv však vyčerpávajícím způsobem, analyzuje poměrně unikátní situaci, kdy národní soutěžní orgán aplikuje jak vnitrostátní, tak evropské soutěžní právo souběžně. Práce se nejprve zabývá se vznikem takového přístupu, právním rámcem spolupráce národních soutěžních úřadů a Komise při aplikaci evropského soutěžního práva, samotným souběhem v řízení před národním soutěžním úřadem a jeho důsledky a v neposlední řadě se zaměřuje na otázky zavinění a deliktního nástupnictví za soutěžní delikty a zabývá se tím, jak se k těmto otázkám postavily orgány Unie a vybrané členské státy a jejich národní soutěžní úřady. Cílem této práce je posoudit, zda je současný stav unijního práva a harmonizace v oblasti souběhu vnitrostátního a unijního soutěžního práva přijatelný. |
Abstract in different language: | Qualification work comprehensively, not exhaustively, analyses rather unique situation, where the national competitive authority applies both national and European competition law in concurrence. It deals with the origin of such approach, the legal framework for cooperation between national competition authorities and the Commission in the application of European competition law, the actual concurrence in the proceeding before the national competition authority and its consequences and finally it focuses on the issue of culpability and succession of liability for a competition offences and examines how the Union institutions and selected Member States and their national competition authorities have approached these issues. The goal of this work is to assess whether the current state of EU law and harmonisation in the area of the concurrence of national and EU competition law is acceptable. |
