| Abstract: | Tato diplomová práce se zabývá institutem privilegovaných závětí v současném právním řádu. Práce zkoumá znovuobnovení tohoto institutu v zákoně č. 89/2012 Sb., občanský zákoník a zaměřuje se na analýzu záměrů zákonodárců a dalších faktorů, které formovaly současnou podobu. V práci je dále věnována pozornost praktickým možnostem a vhodnosti uplatnění privilegovaných závětí v reálné aplikační praxi. Cílem práce je také srovnání nové úpravy s historickým právním rámcem a komparace s vybranými evropskými právními předpisy. Účelem tohoto srovnání je poskytnutý pohled na různé přístupy právních systémů, na základě čehož je možné identifikovat osvědčené postupy a případné nedostatky v české právní úpravě. |
| Abstract in different language: | This thesis deals with the institution of privileged wills in the current legal system. The thesis examines the re-establishment of this institute in Act No. 89/2012 Coll., Civil Code, and focuses on the analysis of the legislators' intentions and other factors that have shaped the current form. The thesis also pays attention to the practical possibilities and usefulness of the application of privileged testaments in real application practice. The aim of the thesis is also to compare the new regulation with the historical legal framework and to compare it with selected European legislation. The purpose of this comparison is to provide an insight into different approaches of legal systems, on the basis of which it is possible to identify best methods and possible weaknesses in the Czech legislation. |
