| Abstract: | Tato diplomová práce se zabývá specifiky řízení o přestupcích se zohledněním judikatury a jejího vlivu na tuto problematiku. V první kapitole se autor věnuje vztahu zákona o přestupcích a správního řádu. Druhou kapitolu této práce tvoří rozbor zákonných ustanovení vymezujících přestupkové řízení chronologicky od počátku (domnělého spáchání přestupku). Třetí kapitola zohledňuje problematiku zkrácených řízení. V kapitole čtvrté autor pojednává o vlivu judikatury na řízení o přestupcích. Vzhledem ke spatřovaným nedostatkům aktuální právní úpravy pak autor v kapitole páté popisuje jím navrhované změny. |
| Abstract in different language: | This diploma work deals with specifications of transgressions proceedings with regard to the judicature acts and their influence on this question. The second chapter of this work is created by the analysis of legal provisions defining transgressions proceedings chronologically from the beginning (supposed transgress commitment).The third chapter regards the questions of summary proceedings.In the fourth chapter the author deals with influence of the judicature acts on transgressions proceedings. Regarding found absence of the actual legal regulations the author describes amendments proposed by himself in the fifth chapter. |
