| Abstract: | Tento elaborát pojednává o českém pojetí institutu smluvní pokuty. V úvodu si práce stanoví dva cíle. Prvním je analyzovat současné problematické aspekty smluvní pokuty a předložit možná řešení daných otázek. Druhý cíl spočívá v porovnání smluvní pokuty s ostatními nástroji zajištění závazku. Díky takovémuto porovnání je poté možné určit, jakou má smluvní pokuty mezi prostředky zajištění pozici. Jako jeden z výsledků této práce bylo shledáno, že smluvní pokuta představuje velice významný nástroj zajištění téměř jakéhokoliv typu obchodního závazku. Ačkoli není smluvní pokuta jediným nástrojem, který dokáže poskytnout efektivní zajištění, lze ho spolu s věcnými nástroji zajištění zařadit na vrchol množiny zajišťovacích instrumentů. |
| Abstract in different language: | This elaborate works with the Czech concept of the contractual penalty (conventional penalty). Two general goals of this work are determined in the introduction. The first is to closely focused on the current problems of the penalty and to present possible solutions to these disputes. The second aim consists of comparing contractual penalty towards other securing instruments and determining the position of the penalty among these instruments. In this work it has been reached a conclusion that the contractual penalty represents a high profile instrument for securing any type of obligation. Although it is not the only instrument that can sensibly guarantee fulfilling of ones commitment it can be with no hesitation considered one of the most important securing tool. |
