Abstract: | Prace se nejprve venuje hudebnimu dilu, rozebírá jeho definici a problemy spojené s jeho upravou v pravnim a muzikologickem smyslu, dále jeho pojmovym znakum a nekterym mezeram v pravni uprave české republiky. Nasledne se venuje fenomenu augmented reality a predstavuje ohledne této problematiky uvahy de lege ferenda pro cesky pravni rad v kontextu unijni legislativy a technickeho vyvoje. Poté se venuje ko-lektivni sprave autorskych prav s důrazem na kolektivni spravce pusobici v Ceske re-publice a Evropske unii. Dále práce analyzuje téma plagiatorstvi v hudbe a využívá komparaci kontinentalnich pravnich systemů a systémů common law, s durazem na relevantni judikaturu predevsim z oblasti Spojenych statů. Prace obsahuje rovnez kapi-tolu venovanou samplingu v hudbe, predevsim v souvislosti s plagiatorstvím. Prace ne-opomiji ani nove alternativy v oblasti ochrany hudebnich del, zejmena institut ne-zavisleho spravce prav, licenci Creative Commons a blockchainove transakce. |
Abstract in different language: | The diploma thesis initially deals with the musical work, its definition, problems associ-ated with its regulation in the legal and musicological sense, as well as its conceptual features and shortcomings of the legal order of the Czech Republic. Subsequently, the thesis focuses on the phenomenon of augmented reality and presents considerations de lege ferenda for the Czech legal system, taking into account the EU legislation and recent technical development. Moreover, my work evaluates collective copyright ma-nagement with an emphasis on collective administrators operating in the Czech Repub-lic and the European Union. Furthermore, it analyses the phenomenon of plagiarism in music, comparing continental legal systems as well as common law systems and pinpointing relevant case law, especially in the United States. The work also contains a chapter devoted to the music sampling, especially in the view of possible plagiarism. The thesis also mentions new alternatives in the field of legal protection of musical works, especially the institute of an independent rights administrator, a Creative Commons license and blockchain transactions. |
