| Abstract: | Diplomová práce se věnuje komparaci vybraných právních aspektů manželství a registrovaného partnerství. V první části práce je vymezena obecná právní úprava těchto dvou institutů a je poukázáno na základní rozdíly mezi nimi. Dále je zde představen pojem homosexualita, její historie a příčiny. Věnuji se i diskriminaci na základě sexuální orientace a cestě k přijmutí zákona o registrovaném partnerství. Ve druhé kapitole je provedena komparace vybraných právních institutů - osvojení, vdovského důchodu, majetkových poměrů, asistované reprodukce a podmínek uzavření manželství a registrovaného partnerství. Závěrečná kapitola je věnována aktuálnímu vývoji v dané právní oblasti - navrhovaným novelám týkajícím se manželství a polské právní úpravě formalizovaného soužití dvou osob. |
| Abstract in different language: | The thesis is devoted to the comparison of selected legal aspects of marriage and registered partnership. The first part of the thesis defines the general legal regulation of these two institutes and points out the basic differences between them. Then the concept of homosexuality, its history and causes are introduced. Discrimination on the basis of sexual orientation and the path to the enactment of the law on registered partnership are also discussed. The second chapter compares selected legal aspects - adoption, widow's pension, property, assisted reproduction and the conditions of marriage and registered partnership. The final chapter is devoted to current developments in the legal field - proposed amendments concerning marriage and Polish legislation on formalised cohabitation of two persons. |
