| Abstract: | Diplomová práce se zabývá institutem přechodu práv a povinností z pracovněprávních vztahů. Na národní úrovni je institut upraven v zákoně č. 262/2006 Sb., zákoník práce. Evropskou úpravu poté představuje Směrnice Rady 2001/23/ES ze dne 12. března 2001 o sbližování právních předpisů členských států týkajících se zachování práv zaměstnanců v případě převodů podniků, závodů nebo částí podniků nebo závodů. Hlavním cílem práce je objasnit čtenáři institut přechodu práv a povinností, součastně taktéž představit a porovnat českou právní úpravu institutu přechodu práv a povinností, jež byla velmi významně novelizována zákonem č. 285/2020 Sb. Práce je členěna do 8 kapitol. V první kapitole je osvětlen pojem pracovního vztahu. Kapitola druhá se věnuje vztahu českého a evropského právního řádu. Třetí kapitola je nejrozsáhlejší a také stěžejní, je v ní představena úprava insitutu přechodu práv a povinností na evropské a národní úrovni, rovněž zde dochází k porovnání součastné české právní úpravy s úpravou předcházející. Čtvrtá kapitola se poté zaměřuje na judikaturu českých soudů před účinností novely č. 285/2020 Sb..Pátá kapitola představuje právní důvody přechodu práv a povinností dle zákoníku práce, a dle zvláštních právních předpisů. V šesté kapitole poté dochází ke stručnému objasnění účinků přechodu. V sedmé kapitole je představena úprava institu přechodu práv a povinností ve Velké Británii. Poslední kapitola poskytuje zhodnocení součastné právní úpravy a úvahy de lega ferenda. |
| Abstract in different language: | The diploma thesis deals with the institute of the transition of rights and obligations from labor relations. At the national level, the institute is regulated in Act No. 262/2006 Coll., Labor Code. The European regulation is then represented by Council Directive 2001/23/EC of 12 March 2001 on the approximation of the laws of the Member States relating to the safeguarding of employees' rights in the event of transfers of undertakings, businesses or parts of undertakings or businesses. The main goal of the work is to clarify to the reader the institute of the transfer of rights and obligations, at the same time to present and compare the Czech legislation on the institute of the transfer of rights and obligations, which was very significantly amended by Act No. 285/2020 Coll. The work is divided into 8 chapters. In the first chapter, the concept of employment relationship is explained. The second chapter is devoted to the relationship between the Czech and European legal systems. The third chapter is the most extensive and also pivotal, it presents the regulation of the institute for the transition of rights and obligations at the European and national level, and also compares the current Czech legislation with the previous regulation. The fourth chapter then focuses on the jurisprudence of the Czech courts before the amendment No. 285/2020 Coll. took effect. The fifth chapter presents the legal reasons for the transfer of rights and obligations according to the Labor Code and according to special legal regulations. The sixth chapter then provides a brief explanation of the effects of the transition. In the seventh chapter, the regulation of the institution of transfer of rights and obligations in Great Britain is presented. The last chapter provides an evaluation of current legislation and de lega ferenda considerations. |
