| Abstract: | Diplomová práce se zabývá problematikou odpovědnosti za účast na společném plánu, kdy pozornost věnuje zejména mauthausenskému procesu. Nejprve je vymezen pojem společného plánu, jak na tento pojem nahlíželi soudci v rámci procesu týkajícím se koncentračního tábora Mauthausen a jeho přidružených táborů, kdy je tento pojem komparován s tím, jak na něj bylo pohlíženo během norimberského procesu. Následně se práce věnuje vymezení odpovědnosti jednotlivce, kdy je pozornost věnována zejména prvku mens rea. |
| Abstract in different language: | The thesis deals with the issue of responsibility for participation in the common design, paying particular attention to the Mauthausen trial. First, the notion of a common design is defined and how this notion was viewed by the judges in the trial concerning Mauthausen concentration camp and its associated camps, when this notion is contrasted with how it was viewed during the Nuremberg Trial. Subsequently, the thesis focuses on the definition of individual responsibility, with particular attention paid to the mens rea element. |
