| Abstract: | V diplomová práce se zabývá problematikou zajištění dluhu. V dílčích kapitolách se postupně věnuje jednotlivým institutům zajištění dluhu. Stručně popisuje jejich historii, probírá současnou legislativu, hodnotí specifika jednotlivých institutů, jejich výhody a nevýhody. U každého druhu zajištění dluhu zdůraznuje jeho nedokonalosti a případné chyby nebo nedostatky právní úpravy. Shrnuje celkový pohled na jednotlivé typy zajištění dluhů v sekci "de lege ferenda". Závěrem rozebírá nedostatky stávající právní úpravy a navrhuje možnosti jejich řešení. |
| Abstract in different language: | This Thesis deals with the issue of securing debt. In individual chapters, it gradually pay attention to debt securing institutes. It briefly wrote about their history, about their current legislation, evaluated their specifics, advantages and disadvantages. For each type of debt securing the thesis highlighted its imperfections and possible errors or imperfections in the legal regulation. I summarized the overall view of the individual types of debt securing in the "de lege ferenda" section. I tried to capture the imperfections of the current regulation and the possibilities of their solution. |
